Terms of Service

The Agreement

These Terms of Service ("Terms") are a binding agreement between you and ServiceBuilt Digital of Conway, Arkansas ("we," "us," "our"). They govern your use of this website and of ServiceBuilt, our field service management software platform, including its web and mobile applications (together, "the Service").

By visiting this website, creating an account, or using the Service, you accept these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business, and "you" means the business.

The Service

ServiceBuilt is software for home service businesses: scheduling and dispatch, customer records, estimates, invoicing, payment collection, customer text and email notifications, and reporting. We also provide web design, SEO, and related digital services under separate agreements.

We work hard to keep the Service available and improving, and we may add, change, or remove features over time. We will not materially reduce the core functionality of a paid plan mid-term without notice.

Accounts

• You must provide accurate information when creating an account and keep it current.
• You are responsible for safeguarding your login credentials and for all activity under your account, including activity by team members you invite.
• Notify us immediately at info@servicebuiltdigital.com if you suspect unauthorized use of your account.

Subscriptions & Billing

• The Service is offered on a subscription basis. Current pricing is published on our website or provided in your order.
• Subscriptions are purchased directly from us and billed to the payment method on file. Payments are processed by PCI-compliant third-party processors; we do not store full card numbers.
• Subscriptions renew automatically at the end of each billing period unless canceled before renewal. You can cancel at any time; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees are non-refundable once a billing period has begun.
• Usage-based charges (for example, text message volume) may apply as described in your plan.

SMS Messaging Terms

The Service can send text messages on behalf of subscribing businesses to their customers — appointment confirmations, technician arrival updates, job status notifications, estimates, invoices, payment receipts, and review requests.

Obligations for subscribing businesses

• You may message only customers who have provided their number in connection with a service relationship and been informed they will receive service-related texts.
• You must honor opt-outs (the platform enforces STOP automatically) and must not re-add opted-out numbers without new consent.
• You must comply with applicable messaging laws and carrier requirements, including the TCPA and CTIA Messaging Principles. Marketing messages require the level of consent those rules demand.
• Prohibited content (as defined by carriers) may not be sent through the Service.

Your Data

Your business data belongs to you. Customer records, job history, estimates, invoices, and everything else you enter into the Service remain yours. You grant us the limited rights needed to host, process, transmit, and display that data in order to operate the Service — nothing more.

You are responsible for having the right to enter the data you enter, including your customers’ contact information. On termination, you may request an export of your data; see our Privacy Policy for retention details.

Acceptable Use

You agree not to:

• Use the Service to break the law, including telemarketing, spam, and consumer-protection laws.
• Send unsolicited or deceptive messages, or messages to people who have opted out.
• Probe, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service or other customers’ data.
• Resell or sublicense the Service without a written agreement with us.
• Upload malicious code or use the Service to store or transmit infringing or unlawful material.

We may suspend or terminate accounts that violate these rules, with notice where practical.

Third-Party Services

The Service relies on and can connect to third-party services — for example, telecommunications carriers and messaging providers, payment processors, and accounting integrations such as QuickBooks Online. Your use of those services is governed by their own terms, and we are not responsible for their acts, omissions, or outages. Message delivery ultimately depends on carriers and is not guaranteed.

Intellectual Property

The Service, including its software, design, and branding, is owned by ServiceBuilt Digital and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription for your internal business purposes. Feedback you send us may be used to improve the Service without obligation to you.

Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that messages will be delivered.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

You may cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk, with notice where practical. Sections that by their nature should survive termination (including Your Data, IP, Disclaimers & Liability, and Governing Law) survive.

Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be brought in the state or federal courts located in Arkansas, and both parties consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page, and for material changes we will notify Platform customers by email or in-app notice. Continued use of the Service after changes take effect means you accept the updated Terms.
